Metalore action dismissed by court

An action brought by Metalore Resources (TSE) against Ontex Resources (ASE) alleging conspiracies in relation to a lawsuit launched by Ontex against Metalore has been dismissed by an Ontario Supreme Court judge.

The judge, in ruling the action is “multiplicitous at this time,” wrote that his decision will not hinder Metalore should it choose “to commence further proceedings when the Ontex actions have been disposed of.”

Central to the legal actions is the Brookbank gold exploration property located near Beardmore in northwestern Ontario and a joint- venture agreement signed by the two companies in 1983. Ontex began legal proceedings in 1986 to rescind that agreement in order to recover the property. Metalore filed a countersuit seeking damages based on a delay of the project.
